Terms of Service

1. The service

MagflowAI lets recruiting firms upload resumes and generate anonymised candidate briefs, pitch emails, and branded exports, plus a set of workspace tools (clients, templates, a shared library, a client-facing sharing portal). We also publish a small number of free, ungated tools at /tools that do the same core processing without requiring an account.

2. Accounts

• You must provide accurate information when creating an account and keep your password secure.
• One account per firm. The firm owner can invite up to 5 people in total, assign roles, and remove access.
• You are responsible for activity that happens under your account, including anything a teammate you invited does.
• We may suspend an account that violates these terms, engages in fraud (Section 6), or creates security risk to us or other users.

3. Acceptable use

You agree not to:

• Upload anything you don't have the right to process — you confirm you have a lawful basis to process each candidate's resume before uploading it.
• Use the service to build a competing product, or to scrape, reverse-engineer, or bulk-extract our AI prompts or generation logic.
• Attempt to bypass usage limits, rate limits, or the fraud-prevention measures in Section 6.
• Use the free public tools (/tools) for anything other than genuinely evaluating the product — they are rate-limited and monitored for abuse.
• Upload malware, attempt to compromise the service, or use it to harass, discriminate against, or unlawfully profile anyone.
• Resell or white-label the service without a separate written agreement with us.

4. Your responsibility for candidate data

Automated anonymisation reduces identifying detail; it does not guarantee anonymity in every case (for example, an unusually specific career history in a small industry may still be identifiable). Review generated briefs before sending them to a client — MagflowAI generates a draft, you are the one submitting it.

5. Trial & billing

• New accounts include a 7-day free trial that starts automatically on signup — no payment card is required to start one. If you add a payment card during the trial, you will not be charged until the trial ends unless you cancel first. After the trial, continued access requires an active paid subscription.
• The trial is limited to 50 generated briefs in total. The paid plan is limited to 280 briefs per calendar month, resetting on the 1st.
• The paid plan is $79/month, billed monthly, covering up to 5 people on one firm account. It is a flat rate, not billed per seat.
• You can cancel at any time from Settings. Cancelling stops future billing; it does not retroactively refund the current billing period unless required by law.
• Prices may change with notice to the account owner before your next billing cycle.

6. Fraud prevention

To keep the free trial sustainable to offer, we use automated measures to detect attempts to obtain repeated free trials — including checks on email address patterns, signup frequency from the same network, and the payment card used to start a trial. If we detect the same payment card starting a second trial under a different account, we may end that trial immediately and begin billing, rather than blocking the account outright. We reserve the right to decline service, without a trial period, to accounts we reasonably believe are attempting to abuse it.

7. Intellectual property

We own MagflowAI's software, design and branding. You own the content of the resumes you upload and retain all rights to your firm's own data (clients, templates, branding you set). By using the service, you grant us the limited right to process your uploaded content solely to provide the service back to you — nothing more.

8. AI output & limitations

Briefs, pitch emails and other generated text are produced by an AI model and, while built to copy dates and facts verbatim rather than infer them, can still contain errors. Review generated output before sending it to a client. MagflowAI is provided as a drafting and processing tool, not as a substitute for your own professional judgement.

9. Availability

We aim for high availability but do not guarantee the service will be uninterrupted or error-free. We may perform maintenance, and rely on third-party infrastructure (Section 6 of our Privacy Policy) that is outside our direct control.

10. Termination

You may close your account at any time. We may suspend or terminate an account for violation of these terms, non-payment, or fraud. On termination, your data is deleted according to the retention terms in our Privacy Policy, except where we're required to retain billing records by law.

11. Limitation of liability

To the maximum extent permitted by law, MagflowAI is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law (for example, liability for our own gross negligence or wilful misconduct, where that limitation isn't permitted).

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the service, your violation of these terms, or your violation of a third party's rights (including a candidate's data protection rights) — since you are the party making the decision to process that candidate's data.

13. Disputes & governing law

These terms are governed by the laws of the United States, without regard to conflict-of-law principles, unless mandatory local consumer-protection law in your own jurisdiction requires otherwise. We'll try to resolve any dispute directly with you first — contact us before pursuing formal action.

14. Changes to these terms

We may update these terms as the product changes. For material changes, we will notify the account owner by email before they take effect. Continued use after that point means you accept the updated terms.
